Photography Service Contract

This photography service agreement made between Brittney Hobein Photography, with a mailing address of N12344 County Road W, City of Colfax, State of Wisconsin and Client (named below)

(Photographer and Client are each referred to herein as a “Party”, and collectively as the “Parties”)

Now therefore, for and in consideration of the mutual promises and agreements contained herein, the Client hires Brittney Hobein Photography to work under the terms and conditions hereby agreed upon by the Parties:

Brittney Hobein Photography agrees to provide the following services:

Services

• Photography session of location

• Professionally edited/retouched images

• Private online gallery to view images

• Appropriate licenses for digital usage of purchased images

(Herein after known as the “Service”)

Brittney Hobein Photography shall, while providing the Service, comply with the policies, standards, and regulations of the Client including local, state, and federal laws to the best of her ability.

Terms and Conditions

• It is understood that Brittney Hobein Photography is the exclusive official photographer retained to perform the photographic services requested on this contract.

• Upon signature, Brittney Hobein Photography shall reserve the time and date agreed upon. Unless Brittney Hobein Photography is able to fully replace the cancelled reservation, all fees and retainers are non refundable if the session is cancelled or rescheduled for any reason other than inclement weather.

• It is understood that Brittney Hobein Photography does not stage or provide cleaning services. The property should be clean and ready to photograph when Brittney Hobein Photography arrives.

• Photographs taken by Brittney Hobein Photography are owned by Brittney Hobein Photography and therefore may be used for the purposes of display, advertising, portfolio, website or any publication to promote Brittney Hobein Photography

• I grant to Brittney Hobein Photography the absolute and irrevocable right and unrestricted permission concerning any photographs that she has taken to use, reuse, publish, and republish the photographs in whole or in part, individually or in connection with other material, in any and all media now or hereafter known, including the internet, and for any purpose whatsoever, specifically including illustration, promotion, art, editorial, advertising, and trade, without restriction as to alteration; and to use my name in connection with any use if she so chooses.

• I further waive any and all rights to review or approve any uses of the images, any written copy or finished product.

• I understand that at no time shall any of Brittney Hobein Photography’s work be printed, sold, advertised, entered into contests, etc. without the express written consent of Brittney Hobein Photography. This is a breach of copyright and is illegal. If high-resolution digital files are included or purchased, the necessary releases will be provided.

• I understand that Brittney Hobein Photography is not responsible for client regret over cleanliness, staging and decor, failure to capture specific images, etc. and therefore does not offer free or discounted re-shoots on this basis.

• I understand that Brittney Hobein Photography reserves the right to artistically interpret image composition and editing as she sees fit and cannot guarantee what photos will be produced from this endeavor.

• I assume all responsibility for precautionary and safety measures. Brittney Hobein Photography is not liable for any injury or damage that may occur before, during, or after a photo session.

• All sales are final.
